Roy Wepner, a partner in the firm, focuses his practice on patent litigation, including appeals before the U.S. Court of Appeals for the Federal Circuit. Mr. Wepner has briefed and/or argued over 35 appeals since the Federal Circuit opened in 1982, plus several appeals to other circuits. In late 2008, Mr. Wepner successfully convinced the Federal Circuit to set aside a jury verdict of infringement of three patents in Johns Hopkins University v. Datascope. Mr. Wepner's Federal Circuit practice has included cases in which our firm took over after a client lost in the district court, including Medpointe Healthcare v. Hi-Tech Pharmacal, where we successfully overturned a preliminary injunction entered against our client. Mr. Wepner's appellate practice has included filings in intellectual property cases at the U.S. Supreme Court, including petitions for and oppositions to certiorari and amicus briefs at both the certiorari and merits stages.
Mr. Wepner's trademark litigation practice has included recent victories in Medi-Flex v. Nice Pak in the District of Kansas against a Kansas-based adversary, as well as Commerce Bancorp v. BankAtlantic, in which our adversary moved for a preliminary injunction, and we successfully obtained summary judgment.
In addition to his litigation practice, Mr. Wepner possesses considerable experience in rendering opinions regarding patents and trademarks.
Mr. Wepner has taught patent law at Rutgers University Law School and trademark law at Seton Hall University Law School. He is also a widely published author on numerous intellectual property law topics. |
