| William L. Mentlik is the managing partner of Lerner, David, Littenberg, Krumholz & Mentlik, LLP. His practice is primarily focused on representing and counseling clients in connection with complex patent litigation in virtually all fields of technology. In particular, he has been extensively involved in pharmaceutical patent litigation brought under the Hatch-Waxman Act. Although principally a litigator, wherever possible, Mr. Mentlik attempts to achieve acceptable business solutions for a client's problems, rather than litigate. A major focus of Mr. Mentlik's representation of clients in patent litigation has been appellate practice. Early in his career, Mr. Mentlik successfully argued an appeal on behalf of laser pioneer Gordon Gould which cleared the way for the issuance and vindication of four broad patents arising out of a 1959 patent application, certain of which dominated significant areas of basic laser technology into the 21st century. Since that time, Mr. Mentlik has argued and/or briefed more than 30 appeals in numerous U.S. Courts of Appeal, including most notably the U.S. Court of Appeals for the Federal Circuit, involving all facets of intellectual property law, technology ranging from display cases to bone implants to cancer treatments, and involving legal issues ranging from the Process Patent Amendments Act of 1988, to nuances of the Hatch-Waxman Act. Mr. Mentlik has extensive experience in evaluating and pursuing appeals before the Federal Circuit in cases where other firms have obtained disappointing results.
Mr. Mentlik was a Patent Examiner in the United States Patent and Trademark Office from 1969 to 1973 and he also served as a trial attorney with the United States Department of Justice, Antitrust Division, Patent Section, from 1973 to 1975. He has been listed since 1991 as one of the “Best Lawyers in America” by Woodward/White and has been recognized by Chambers USA directory as one of America’s Leading Lawyers in the field of intellectual property litigation. |
